LOYALTY TERMS AND CONDITIONS

• INTRODUCTION

1.1 Al- Ikhsan Sports Sdn. Bhd. Loyalty Programme is a loyalty programme offered by Al-Ikhsan Sports Sdn. Bhd. (“Al-Ikhsan Sports Sdn. Bhd.”, “we” or “our”) to customers located in Malaysia.

1.2 These Terms and Conditions shall govern your participation in Al-Ikhsan Sports Sdn. Bhd. Loyalty Programme and the use of the Mobile App. By registering for membership in the Loyalty Programme and accessing, participating or using the Mobile App, you agree to comply and to be bound by these Terms and Conditions incorporated herein by reference, including any amendments to these Terms and Conditions. Al-Ikhsan Sports Sdn. Bhd. may update these Terms and Conditions from time to time. Any significant changes affecting your rights and obligations will be communicated via email or apps notification at least 14 days before the changes take effect. Continued participation in the Loyalty Programme after the implementation of the changes shall constitute as your acceptance of the revised terms.

1.3 By successfully signing up as a member to the Loyalty Programme, you (‘Member’) are deemed to have read, understood, accepted and agreed to be bound by each term and conditions as contained in these Terms and Conditions. The Terms and Conditions stated herein constitute a legal agreement between you and Al-Ikhsan Sports Sdn. Bhd.

1.4 If you do not agree to all of these terms, do not access or participate in Al- Ikhsan Sdn. Bhd. Loyalty Programme.

• MEMBERSHIP ELIGIBILITY

2.1 Membership is open to individuals aged 18 years and above. Employees of Al-Ikhsan Sports Sdn. Bhd. and/or its affiliated companies may be eligible for membership but may be subjected to additional restrictions imposed by Al-Ikhsan Sports Sdn. Bhd.

2.2 Al-Ikhsan Sports Sdn. Bhd. Loyalty Programme account registration process may require that you provide certain personal information, including email address, name and date of birth, and your marketing preferences.

• REWARDS AND POINTS ACCUMULATION

3.1 Members can earn points through qualifying purchases made at participating Al-Ikhsan Sports Sdn. Bhd. stores. There will be no minimum capped for Members to earn points.

3.2 Points will be credited to the Member’s account within 48 hours of the transaction.

3.3 Points are not transferable and cannot be exchanged for cash. Usage of vouchers are only applicable for cash value. If the voucher value is greater than the total invoice, Al-Ikhsan Sports will not provide any refund to the Members.

3.4 For cancelled orders, the points earned for that purchase will be deducted from your accounts and any vouchers utilized/issued will be reissued to/deducted from your account. Loyalty Programme points deduction and reissuance/deduction of vouchers may take up to 7 days processing time.

• POINTS REDEMPTION

4.1 Points can be redeemed for rewards as specified in the Mobile App. All points redeemed cannot be refunded or exchanged for cash.

4.2 Al-Ikhsan Sports Sdn. Bhd. reserves the right to modify and/or adjust the rewards catalogue and redemption criteria at any time in its sole discretion and without prior notice.

4.3 Unutilized points will no longer be valid for use upon expiry. Any request for extension will not be entertained.

• MEMBERSHIP TERMINATION

5.1 Al-Ikhsan Sports Sdn. Bhd. reserves the right to terminate or suspend any membership that violates these Terms and Conditions. Members will be notified of the reason for such termination and may appeal on the decision within 14 days from the termination or suspension date by contacting: customer.service@al-ikhsan.com.my. Al-Ikhsan Sports Sdn. Bhd. will review all appeal and provide a final decision within 30 days from the date of appeal. The decision of Al-Ikhsan Sports Sdn. Bhd. shall be conclusive and binding.

5.2 You may request to delete or voluntarily terminate your account by contacting customer.service@al-ikhsan.com.my. It may take us up to 30 days to process the termination of your account. Please note that all account termination requests are final and irreversible once processed. Once your account has been successfully terminated, all information and benefits associated with your deleted account will not be accessible or recoverable, including your account history and points.

5.3 Upon termination, all accumulated points will be forfeited and cannot be reinstated unless the termination is due to a system error or an overturned appeal. In such cases, accumulated points maybe reinstated at the discretions of Al-Ikhsan Sports Sdn. Bhd.

• PRIVACY POLICY

6.1 Al-Ikhsan Sports Sdn. Bhd. respects your privacy and is committed to protecting personal data in accordance with applicable laws and regulations. We do not sell or share your personal data with third parties without your explicit consent, except as required to operate the Loyalty Programme or to comply with legal obligations. You may update your marketing preferences or request the deletion of your data by contacting: customer.service@al-ikhsan.com.my.

6.2 Al-Ikhsan Sports Sdn. Bhd. may share your information with marketing service providers to access, develop and provide you with promotions and special offers that may interest you or for other promotional purposes.

• INDEMNITY

7.1 Each Member shall indemnify and hold Al-Ikhsan Sports Sdn. Bhd. and their respective directors, officers, employees, agents and contractors harmless from and against any and all claims, proceedings, loss, damage, costs and expenses (including legal costs on a full indemnity basis) incurred, suffered or sustained by Al-Ikhsan Sports Sdn. Bhd. and their respective directors, officers, employees, agents and contractors directly or indirectly arising from or relating to the Member’s participation in the Loyalty Programme.

• INTERNET DELAYS

8.1 The Loyalty Programme and/or the Mobile App may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. Al-Ikhsan Sports Sdn. Bhd. shall not be held responsible for any failure in recording points accumulation, redemption of points, or other privileges, as well as other Mobile App usage-related failures.

8.2 Al-Ikhsan Sports Sdn. Bhd. cannot guarantee uninterrupted service but will make reasonable efforts to resolve technical issues. If a system failure results in the loss of accumulated points or redemption errors, affected members may within 14 days contact: customer.service@al-ikhsan.com.my for investigation and potential resolution.

• LIMITATION OF LIABILITIES

9.1 Al-Ikhsan Sports Sdn. Bhd. shall not be liable for any losses, damages, rights, claims, or cause of action, including but not limited to any damage or loss to property, injury, or any indirect, punitive, special, or incidental damages associated with or arising from participation in the Loyalty Programme and use of the Mobile App.

9.2 Members of the Loyalty Programme assume all risks and liabilities for loss or damage arising from his or her participation in the Loyalty Programme.

• INTELLECTUAL PROPERTY RIGHTS

10.1 Al-Ikhsan Sports Sdn. Bhd. shall own all rights, title, and interest, including all related intellectual property rights, in and to the Loyalty Programme, Website, and Mobile App.

• NOTICE

11.1 Al-Ikhsan Sports Sdn. Bhd. may give notice by means of a general notice on the Website, Mobile App, electronic mail, WhatsApp, or SMS based on the information provided by you.

• GOVERNING LAW AND JURISDICTION

12.1 This Agreement shall be governed and enforced in accordance with the laws of Malaysia. The Parties agree to submit to the exclusive jurisdiction and venue of the Malaysian courts in respect of all matters relating to these Terms and Conditions.

• NO WAIVER

13.1 Any failure or delay by Al-Ikhsan Sports Sdn. Bhd. to enforce any right or provision in these Terms and Conditions shall not constitute a waiver of any subsequent or continuing right or of any other provision of these Terms and Conditions.
